Ditech my mortgage servicer formerly, who filed bankruptcy, appears to have sold my mortgage to ShellPoint.
This is the collections agent calling me, for which they were apprised I am represented by an attorney and that they should be calling the attorney, instead of trying to negotiate a settlement with myself. This was the second time they have tried to circumvent my attorney who has been representing me for a year, and two prior attorneys of the mortgage company.
I had sent them an email with this information (attorney engagement letter and contact info), and they acknowledged receipt of such by email.
25 days later they called me again, claiming they are unaware, again trying to bypass my attorney and negotiate a settlement.
Then they directed me to call a specific person within their company and explain such. They were told to create an internal email and send such to the email id they were trying to have me contact. If I open a line of communications with them, then legally I started it, and good luck proving they initiated such. This gets them off the hook for contacting a person represented by an attorney. This is legal game playing.
The number as Shellpoint is legit but this is a collections service using collections tactics and the collections agents are likely attorneys who should know the law.
They were ultimately informed that I have verbally and in ink by email placed them on notice of who to contact when I have an attorney. When I did such priorly verbally, and by email, I have met my obligation. I also advised I had given the fax number to my attorney for which he faxed them his information.
So it appears, Shellpoint is willing to bypass persons represented by an attorney to try to negotiate a settlement they might not be entitled to.
The public should be aware of this tactic.
