Pinnacle has helped me settle my old debt thought this was a scam spoke to my tax accountant they have every right to file a 1099c. I settled for Way less than what I would have owed the IRS... DO YOUR HOMEWORK
I received a call from Miranda today, she is extremely mean and very rude. I'm filing a complaint against her. She left a message with my child the other day and was extremely nasty. She's pretending to file a 1099-C in reference to a 15 year old credit card. I have researched her online and also googled this Pinnacle Asset Group company. They are a huge scam and have been sued over 50 Times! Do not pay her! File a lawsuit, or call police if she speaks to your child!

This group of rip off artists called my mom and had her in tears thinking she would have no money and would be going to jail for not paying the IRS. I had to talk her off the ledge then explain to her that there are some slimy [***] people in the world who would love nothing more than to steal her information. Now I'm posting here and will be reporting this number to whoever I have to as fraud.

I posted the info so people can be informed and make a decision based on FACTS.... IRS states that any defulted Debt _Credit Cards or Loans as accountable income... I was hit with this after I got the call.. Because people like you posted this crap.. Needless to say I now owe over $10,000 in taxs on a credit card that went off my credit reprot back in 2008... Now I have to figure out what to do about this .. Give correct info instead of misleading people in the first place... IRS 1 800 829 1040-- ask what a 1099c is its a cancelation of debt... 7. I got a 1099-C for a very old debt. Is that legal?
This is another tricky situation, and we have received numerous complaints from consumers who have received these forms for bills they had stopped paying on long ago. Creditors who follow IRS guidelines should send out 1099-Cs when debts lie dormant for three years and there has been no significant collection activity for the past year. Specifically, the IRS instructions for 1099-C state:
“The expiration of non-payment testing period. This event occurs when the creditor has not received a payment on the debt during the testing period. The testing period is a 36-month period ending on December 31.”
It goes on to say that the creditor can rebut this occurrence if “The creditor (or a third party collection agency on behalf of the creditor) has engaged in significant bona fide collection activity during the 12-month period ending on December 31.”
The problem is that if a creditor sends out a 1099-C years (or decades), after it’s supposed to, the responsibility falls upon the taxpayer to try to explain to the IRS why they believe it should not have been filed that year. Again, there is no specific form for reporting this kind of dispute. You’ll have to include an explanation and you may wind up arguing with the IRS to get it resolved.
