"Government Actions
The following describes a government action that has been resolved by either a settlement or a decision by a court or administrative agency. If the matter is being appealed, it will be noted below.
On July 15, 2013, the Government of Alberta (Service Alberta) issued an Undertaking to Action Collections and Receivables Management under Section 152 of the Fair Trading Act.
According to the Undertaking, Action Collections and Receivables Management acknowledges that they have breached sections of the Collection and Debt Repayment Practices Regulation, and the Fair Trading Act. Some examples are as follows:
- Initiating phone calls that exceed the frequency permitted in the regulations
- Continuing collection activity after being informed that the individual contacted was not the debtor
- Providing false or misleading information to a reporting agency by posting a derogatory listing in error on a resident's credit file
- Allowing employees who did not possess a collector's license in Alberta to contact residents for collection purposes
- Engaging in collection activities on debts where the last payment or written acknowledgement of the date was more than six years previous.
Action Collections and Receivables Management acknowledges that they have failed to comply with the provisions of the Fair Trading Act and undertakes to the Director that they will not, to the best of their ability, at any time hereafter, engage in acts or practices similar to those described.
Action Collections & Receivables Management is responsible to pay the amount of $2,000.00 to the Minister of Finance of Alberta. This amount represents a portion of the costs associated with the investigation.
