Actual Custody Versus Illusory Future Right to Ask for Custody
Mother has sole custody of the child for both legal and physical residential pursposes. (LF138).  Father (Comer Rex Phillips) has no rights to custody or visitation either under the judgment. (Id.; Tr.224).
Mother suffered a statutory rape and/or sodomy at the hands of Father (COMER REX PHILLIPS) when she was a teenager. (Tr. 219, 220); See, R.S.Mo. §§566.034; 566.064; 566.010.  (statutory rape/sodomy defined).  The sexual conduct lasted for approximately 15 years into the future, and resulted in the child at issue.  Father was approximately 52, (Tr.6), and Mother was 15-16. (Tr. 62, 218-220)).  There are certain statements made during Father’s Brief that are not directed to any part of Father’s Points or Arguments (Father’s Br. 11-20).  As set forth in Mother’s Initial Appellant’s Brief, Mother acknowledges that she testified about those topics, and she was exhonerated (Mother’s Br. 13, n.5), and that the trial court considered them in making its own credibility determinations against Father(LF79, ¶9).  Without belaboring the point, it is understandable that a woman who has undergone this type of prolonged sexual trauma might have some complications with lasting implications based thereon.
While it might be common for an abuser to want to keep a level of control over his former victim, it should not be permitted in this case. (COMER REX PHILLIPS) Father's conduct demonstrates that he is not actively trying to be a part of the child’s life.  He abdicated any custody or visitation with the child. (Tr.224).  The desire to keep “relocation notice” in the judgment appears to amount to Father's desire to maintain the ability to keep tabs on Mother.
