As another person noted, I also just spoke with Chris Monteras, who identified himself as the "General Manager" of Club Ember. He heard my complaint of ongoing texts from De La Vega in Aug 2010, Nov 2010, Jan 2011, March 2011 and now Apr 2011, despite my attempts to block each number the texts come in on and despite my repeated requests to De La Vega to be removed from whatever lists he was using to text. I explained to Chris I no longer even LIVE in CA, haven't for over a year and a half, and not only are the texts annoying and costing me thru my provider, are coming in in the middle of the night where I live and that is unacceptable. I was told De La Vega is an "independent contractor" and had been given "written guidelines" in Aug 2010, chastised in Dec 2010 for complaints re his texts, but that contact by Club Ember to the FCC to determine their rights and upon being told as long as he wasn't directing ppl to a website, the texts were "legal" and as, according to Chris, they were continuing to "bring in business", they let it go on. I advised him that MY complaint was NOT to the FCC but was to the FTC (who regulates the "Do Not Call Registry") and had been told by THEM they had rec'd numerous complaints and were "collecting" the phone numbers the texts were sent from and it was an "ongoing investigation" which could, of course, go on for an indeterminate amount of time. That was why I contacted Chris as a last resort to attempt to remove my number from this list of De la Vega's. Independent contractor or not, he is an agent of Club Ember and is acting on their behalf and at their behest and they are ultimately the responsible party. I believe he heard me but will repost in a month to update as to whether or not I have rec'd anymore texts.
