Sounds like a collection agency. Do talk to a collection agency ever!!! If you owe money to
anyone, the only way the only way they can get your money is to take you to court. A collection agency has no legal rights. The only thing they can do is hire a law firm to collect the money. Collection agencies are a joke and I have to laugh at their tactics. They get to keep 25% of any money they bully out of people so they will try anything to get your money. But since a collection agency has NO LEGAL RIGHTS, I am always amazed that anyone talks to them at all. If you owe money and want to negotiate payments, wait until the debt goes to a law firm. The law firm will send you a letter and then you can negotiate with the law firm. Once a law firm sends you a letter, the next step is that they will try to have you served with a summons and complaint. They will usually use a private process server and if you are broke like most of the country then just don't answer the door. A summons and complaint HAS TO BE SERVED IN PERSON to you or to a member of your family in your home over the age of 18. I repeat this has to be done in person. They can't just leave it on the doorstep or with a neighbor. Sometimes they will hire a county sheriff to try and serve you but don't open the door to the county sheriff. It is a summons, not a warrant. A county sheriff is not a city police officer. -- they cannot come into your house unless you open the door. Some process servers can get pretty aggressive once they figure out that you are avoiding service but if you are careful - watch for strangers sitting in cars around your house, watch for delivery people, watch for a county sheriff -- you can avoid being served. Unless they serve you in person with a summons and complaint, there is nothing they can do to you. ONLY A COURT CAN ORDER A GARNISHMENT OR TAKE MONEY FROM YOUR BANK ACCOUNT. If you get a call from a collection agency, hang up - you do not have to deal with them. Period!
