They say we're a law firm,I don't think so,try again!
The recorded message claims to be a Law Office. A records check shows the number to be a Collections Agency. More than likely very old debt was purchased and they can no longer take the issue to Small Claims unless you agree to do so. This can happen if you agree to anything with them. If a Collections Agency is calling ask for the Ontario Registration number, they have to give it to you according to the law. Say nothing else, hang up and then look up what your rights are and what the limitations are for Debt Collectors. In many cases on old debt there is nothing much the debt collector can do when there was no Court action and the time expired. If it is a law firm (I doubt it) ask for the legal practitioners full name, licence classification and Law Society number. The manner in which they contact you is similar to Collections Agencies. Both entities must send written Notice before they can contact you. Legal practitioners also follow a code of conduct and can not threaten to take action that they cannot take such as sue you in Small Claims Court when the statute limitation has expired. There are rules that must be followed and a complaint mechanism for you to use. Many lawyers licenced with the Law Society offer free consultations so feel free to call one that offers free information or contact the Law Society for a referral. Don't get intimidated or bullied. Simply get to know your rights under the law and their limitations to act.
